TERMS AND CONDITIONS – ICHIBAN JEWELRY
IMPORTANT NOTICE REGARDING PRODUCTION NATURE (MAKE-TO-ORDER)
All Ichiban jewelry, specifically all rings, are NOT mass-produced items from stock. They are individually handcrafted after the order is placed, according to the size, color, and material specifications chosen by the Buyer. Consequently, our entire collection falls under the category of goods made to the consumer's specifications (personalized products) and is EXEMPT from the right of withdrawal/return, in accordance with Art. 16, let. c of GEO 34/2014.
1. DEFINITIONS AND INTELLECTUAL PROPERTY (IP)
Designer Products: All goods sold on www.ichiban.jewelry or www.ichiban.ro are original creations of designer Daniela Bordeanu.
Legal Protection: The brand “Ichiban Excellency in Handmade by Daniela Bordeanu” is a registered trademark at European (EUIPO) and International (Madrid Monitor) levels. Designs are protected as industrial property.
Prohibitions: Copying, reproducing, or using the designs, modeling techniques, photographs, or texts without written consent is strictly prohibited. Purchase grants physical ownership but does not transfer copyrights over the design.
2. NATURE OF MATERIALS AND TECHNICAL SPECIFICATIONS
Handmade: Jewelry is handcrafted (cold modeling, weaving), not industrial. Small variations in shape or texture are the artisan’s signature and confirm each piece's uniqueness.
14K Gold Filled: A superior technical material (US standard), consisting of a thick layer of 14K gold mechanically bonded to a base metal.
NOTICE: It is NOT solid gold. The accessible price reflects its nature as a high-quality composite material.
Raw Materials Diversity: Each product includes a brief description with links to extensive technical specifications. It is imperative to review this documentation before purchase to ensure an informed choice and avoid future disputes.
Stock Availability: At Ichiban, "in stock" refers to the quantity of premium materials reserved to create that specific model. It does not mean the product exists in a finished state. Each piece is handcrafted from scratch only after order confirmation. This ensures your jewelry is freshly made, sanitized, and tailored to your specifications, requiring the execution time mentioned in the product description.
Commercial Ethics: Each piece represents a significant investment of time and resources. We reserve the right to prioritize clients who demonstrate they have read the provided information, thus avoiding unjustified stock blocking due to overlooked specifications.
Designer Upgrade (January 2026):
To maintain Ichiban standards, we have replaced prefabricated leverback components with handcrafted, secure closures made in our studio. As this upgrade applies to hundreds of models, website photos are updated gradually. Your jewelry may feature these superior handcrafted closures even if the photo shows the previous industrial version. This modification represents an increase in the product's value and durability.
3. ORDER AND PAYMENT POLICY
Validation: Orders require mandatory phone/email confirmation for consultancy (sizing/colors). We reserve the right to cancel orders if the validation call remains unanswered.
Prepayment: Mandatory for custom-sized rings, color-personalized items, or clients with a history of unclaimed packages.
Priority: Orders paid online (Card/PayPal) are prioritized in the production workflow.
4. DELIVERY AND RISK TRANSFER
Commitment to Receive: By confirming the order, the Buyer commits to receiving the package. Failure to collect personalized products causes direct financial prejudice to the studio.
Risk Transfer: The risk of loss or damage passes to the Buyer upon physical possession of the product.
Package Integrity: The Buyer must inspect the packaging upon delivery. If damaged, the package must be refused, and a formal report (proces-verbal) must be filed with the courier.
5. RETURN POLICY AND EXCEPTIONS
PERSONALIZED PRODUCTS (NON-RETURNABLE): Rings made to size or pieces modified upon request CANNOT be returned.
Security Seal: Returns are not accepted if the Ichiban seal is broken. For earrings, only one piece is sealed for trial; breaking the seal voids the return right for hygiene reasons.
Costs: Return shipping fees are the responsibility of the client. For returns on "Free Shipping" offers, the initial shipping cost will be deducted from the refund.
6. WARRANTY AND "ANTI-GLUE" CLAUSE
Warranty (24 months): Covers material conformity and manufacturing defects. It does not cover loss, accidental snagging, or the wear of rings (considered occasional-wear fine pieces).
Automatic Voiding: The use of adhesives (e.g., "Super Glue") or unauthorized DIY repairs leads to the automatic cancellation of the warranty, as the piece becomes technically irreparable.
Service Limits:The warranty is not a subscription for free repairs due to wear or mishandling. Any intervention not based on a manufacturing defect will be evaluated individually, with labor and shipping costs borne by the client.
Wear and Maintenance: Fine jewelry requires preventive care. The warranty cannot be invoked for mechanical damage, deformation, or breakage of delicate elements resulting from daily wear; these are considered wear-and-tear incidents, not product defects.
7. DATA PROTECTION (GDPR)
Data is collected strictly for validation, invoicing, and delivery. Tax laws require keeping invoice data for 5 years.
8. LIMITATION OF LIABILITY AND FORCE MAJEURE
The Seller is liable up to the price paid for the product and is not responsible for damages resulting from improper use or unforeseeable events (Force Majeure).
